Landlord Possession Services

Stage 2

Issue your claim at court

Your notice period has ended and your tenant is still there. We'll prepare your full court claim, every date, ground and figure checked, ready for you to sign and for us to post to the court.

£199

+ £415 court fee, paid by you to the court when it phones you

You can start once the earliest date in your notice has passed, and within 12 months of serving it.

Served your own notice? Start here. We'll check your notice first, before you pay.

Have these ready

  • Your Section 8 notice
  • Proof it was served: the signed court paperwork and proof of posting
  • Your tenancy agreement
  • An up-to-date rent statement (rent arrears claims)
  • Deposit certificate and prescribed information, gas safety record, EPC, electrical safety report and Renters' Rights Act information sheet, each with proof it was given to your tenant

No proof for a document? We'll send you to Stage 1a to serve it again.

What happens next

  1. Within 2 working days, we send your claim and court bundle to sign on your phone.
  2. Within 2 working days of getting it back, we post it to the court and email you an electronic copy of your bundle.
  3. The court phones you to take the court fee, then sends the claim to your tenant.
  4. The court sets a hearing, usually 8 to 10 weeks later. Go yourself, or instruct a solicitor or advocate.

You stay the claimant. We're a document preparation and posting service, not solicitors, and we don't give legal advice or attend hearings.
